Terms of Services (online sales)

These Terms of Service apply to purchases of wine made through the Two Coqs Wines website.

Liquor Licence and Responsible Service

Two Coqs Wines sells alcohol under NSW liquor licence number LIQW880015647. Liquor is sold under and in accordance with that licence.

The following warning applies to all sales: “It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years.”

Age Verification

Wine may only be purchased by persons aged 18 years or older. By placing an order you confirm and warrant that:

• you are at least 18 years of age;
• the person receiving the delivery is at least 18 years of age; and
• you will produce valid photo identification on request at the time of delivery or collection.

Our carrier may require proof of age on delivery. Alcohol will not be handed to any person who appears to be under 18 and cannot produce valid ID, or to any person who is intoxicated, and will not be left unattended. Where a compliant delivery cannot be completed, the order may be returned to us and re-delivery or refund handled in accordance with our Refund Policy.

Orders

All orders are subject to availability and acceptance. A contract of sale is formed only when we accept your order and dispatch the goods. We reserve the right to refuse or cancel any order, including where required by law, where products become unavailable, where we suspect fraud, or where we cannot verify that the purchaser is aged 18 or over.

Pricing

All prices are shown in Australian Dollars (AUD) and include GST unless otherwise stated. Prices exclude delivery charges unless stated. We may correct pricing errors before dispatch and will contact you if a price has changed materially.

Payment

Payment is required in full before orders are dispatched. Payments are processed securely by our third-party payment providers Stripe & Paypal. We do not store your full card details.

Shipping and Delivery

We currently ship within Australia only. Delivery charges (if any) are shown at checkout. Delivery times are estimates only and may vary depending on your location and the carrier. An adult (18+) signature may be required on delivery. You are responsible for providing a complete and accurate delivery address; we are not liable for delays or failed deliveries caused by incorrect address details or by no eligible adult being available to accept the delivery.

Risk and Ownership

Ownership of the products transfers once payment has been received in full and the goods have been delivered. Risk in the goods passes to you on delivery.

Events Beyond Our Control

We are not liable for any failure or delay in performing our obligations where that failure or delay results from events beyond our reasonable control, including extreme weather, fire, flood, supply shortages, carrier delays, industrial action or acts of government.

Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits or excludes your rights under that law.

Governing Law

These Terms of Service are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
